In an effort to cause the least amount of upset, we chose to “phone a friend” and share the petition without fanfare or broad reach. We followed the LLH bylaws, and attempted to do so with great respect from the moment the petition was delivered. The board, POA staff, and POA attorney have chosen to turn this into a personal popularity contest. Their supporters have shown you through their actions and even on video during the last board/informational meeting that they are the ones escalating emotions.
What if I get a call from management or the board about my recall petition signature?
- You are not required to explain why you signed.
- It is acceptable to confirm you signed, but you are not obligated to discuss your reasoning.
- You cannot be penalized for signing a recall petition; the right to petition and vote for removal is protected under North Carolina law and Land Harbor Bylaws.
- If you feel pressured or threatened, politely decline to discuss and request that all communication be put in writing.
- Document the interaction (date, time, who called, and what was said). This record may be important if the POA’s actions are challenged later.
- Remember: verification of signatures is to ensure eligibility, not to discourage participation. Attempts to intimidate or coerce withdrawal may be a breach of fiduciary duty by the POA.
